Important Information

These terms and conditions govern your use of the services provided by Eagle Rock Technologies, Inc. By utilizing our services and purchasing our product you have accepted our Terms and Conditions of Sale in effect as of the date of purchase or placed order. Our commitment to quality and your satisfaction is paramount. Eagle Rock Technologies, Inc. as proudly been doing business for over 60 years. The products we manufacture always prioritize quality and extending the life of our tooling as much as possible.

Privacy and Security Policy

Eagle Rock Technologies, Inc. respects your privacy and is committed to protecting your personal information. We implement various measures to maintain the safety of your information. This policy outlines how we collect, use, and safeguard your data. We may update this policy occasionally, and it is your responsibility to review it periodically. If you have any questions regarding this policy or our practices related to your personal information, please do not hesitate to contact us. Your trust is important, and we take it seriously.

Limitation of Liability Clause 

To the maximum extent permitted by applicable law, Eagle Rock Technologies, Inc. shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of business, or loss of anticipated savings, arising out of or relating to the sale, use, or performance of any products or services, even if advised of the possibility of such damages.

In no event shall Eagle Rock Technologies, Inc.’s total liability for any claim arising out of or relating to these Terms, the products, or the services exceed the amount paid by the customer for the specific product giving rise to the claim.

Eagle Rock Technologies, Inc. shall not be responsible for any delay, failure in performance, or interruption caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, severe weather, fires, floods, labor disputes, war, terrorism, government actions, supply chain disruptions, carrier delays, equipment failures, power outages, or shortages of materials.

Nothing in these Terms shall limit or exclude liability for personal injury, death, fraud, gross negligence, willful misconduct, or any other liability that cannot be excluded under applicable law.

Pricing and Charges

Our Product: All of our prices and charges in current Eagle Rock Technologies, Inc. catalogs are effective upon their publication or immediately when displayed on our website. Our pricing for all of our products and parts that make up our products are subject to change without notice. All of our prices are quoted in U.S. Dollars (USD). 

 

Charges: All orders placed to Eagle Rock Technologies, Inc. are subject to applicable shipping, freight, taxes, and processing charges. Carriers may impose surcharges, which may vary by carrier and may change at the carrier's discretion.

Tarrifs, Duties, other Fees: Prices are subject to increase at any time, including after an order is placed, due to tariffs or other regulatory charges, which Eagle Rock Technologies, Inc. will pass through to the Customer. Purchases affected by such price increases may be returned subject to Eagle Rock Technologies, Inc. return policy.

Terms and Billing Options

Net 30 days on approved open accounts from date of invoice. In addition to open accounts, we also accept cash, C.O.D. and most major credit cards. Eagle Rock Technologies, Inc. has multiple payment/billing options. Eagle Rock Technologies, Inc. may charge a convenience fee for credit card payments. Eagle Rock Technologies, Inc. also offers an online ACH payment option and is preferred for distributer accounts for quick transactions. If an open account customer fails to make full payment within thirty (30) days from date of invoice, Eagle Rock Technologies, Inc. reserves the right to defer any further shipments or other orders until the required balance is paid, or in more extreme cases orders may be canceled for any portion of an unshipped order.

Delivery

Domestic (U.S.A.): Deliveries are made Monday through Friday, daytime hours only. Most orders are shipped UPS and Eagle Rock Technologies, Inc. prefers that our customers utilize UPS but will pursue other carriers if needed. Eagle Rock Technologies, Inc. also uses various carriers for different regions. Items that are drop shipped directly from manufacturers may take longer to arrive at their destination, so items ordered together may not always arrive in the same box or on the same day.

International: Deliveries are made Monday through Friday, daytime hours only. Most orders are shipped UPS. Eagle Rock Technologies, Inc. also may use various carriers for different regions or countries depending on available carries for that region or country. We offer international shipping to selected countries. Delivery times are estimates only and are not guaranteed. Eagle Rock Technologies, Inc., reserves the right to select the most appropriate shipping carrier and method unless otherwise agreed in writing. Estimated delivery times vary by destination and are provided for reference only. We are not responsible for delays caused by customs, carrier issues, weather conditions, or other events beyond our reasonable control. The customer is responsible for all customs duties, import taxes, VAT, brokerage fees, and other charges imposed by the destination country. These charges are not included in the purchase price or shipping fees unless expressly stated. International shipments may be subject to inspection and clearance procedures that can cause delays. The customer agrees to provide any information required for customs processing. The customer is responsible for providing accurate shipping information. Eagle Rock Technologies, Inc. are not responsible for delays, losses, or additional costs caused by incorrect or incomplete addresses.

Returns and Refunds Policy

  1. Return Authorization Required
    All returns must be approved in advance. Customers must obtain a Return Merchandise Authorization (RMA) number from Eagle Rock Technologies, Inc. before returning any product. Returns without an RMA may be refused.

  2. Return Eligibility Period
    Return requests must be submitted within 30 days of the original delivery date, unless otherwise agreed in writing.

  3. Condition of Returned Items
    All returned products must be:

    • Unused

    • Unaltered

    • In original packaging

    • In resalable condition

    We reserve the right to reject returns that do not meet these requirements.

  4. Non-Returnable Items
    The following items are not eligible for return:

    • Custom, special-order, or made-to-specification products

    • Used, installed, or modified items

    • Clearance or discontinued items (unless defective)

    • Items damaged due to misuse, improper handling, or improper storage

  5. Defective or Incorrect Items
    If a product is defective, damaged in transit, or shipped incorrectly, the customer must notify us within 7 days of receipt. Upon verification, we will, at our option:

    • Replace the item, or

    • Issue a refund or credit.

  6. Return Shipping Costs

    • If the return is due to our error, we will cover reasonable return shipping costs.

    • For all other approved returns, the customer is responsible for return shipping and insurance.

  7. Restocking Fee
    Approved returns that are not due to our error may be subject to a restocking fee of up to 15% of the original purchase price.

  8. Inspection and Processing
    All returned items are subject to inspection. Refunds or credits will be issued after inspection and approval. Processing typically takes 10–14 business days after receipt of the returned product.

  9. Refund Method
    Refunds will be issued using the original method of payment or as a store credit, at our discretion, unless otherwise required by law.

  10. Risk of Loss for Returns
    Customers are responsible for returned items until they are received and accepted by Eagle Rock Technologies, Inc. We recommend using a traceable and insured shipping method.

  11. International Returns
    For international orders, customers are responsible for all return shipping costs, customs duties, taxes, and brokerage fees. Original shipping charges are non-refundable.

  12. No Returns After Modification
    Products that have been altered, sharpened, re-coated, or otherwise modified after delivery are not eligible for return.

Intellectual Property and Proprietary Rights

  1. Ownership of Intellectual Property
    All trademarks, trade names, service marks, logos, product names, designs, technical data, specifications, drawings, documentation, software, website content, and other intellectual property, whether registered or unregistered, are and shall remain the exclusive property of Eagle Rock Technologies, Inc. or its licensors.

    This includes, without limitation, the following brands, product lines, and proprietary marks:

    • Wettstein Tool™

    • Knurlcraft™

    • ANTI-BACKLASH™

    • SHAPLANE™

    • PACKER™

    • BUSHETTE™

    • HI-LO™

  2. Limited License to Use
    Eagle Rock Technologies, Inc. grants customers a limited, non-exclusive, non-transferable, revocable license to use its intellectual property solely for the purpose of identifying and using purchased products in the ordinary course of business. No ownership rights are transferred.

  3. Restrictions on Use
    Customers and third parties may not, without prior written consent from Eagle Rock Technologies, Inc.:

    • Copy, reproduce, modify, or distribute any proprietary materials

    • Reverse engineer, disassemble, or attempt to derive designs or processes

    • Remove or alter trademarks, labels, or identification marks

    • Use any trademarks or trade names in advertising, domain names, social media, or promotional materials

    • Create derivative products or confusingly similar products

    • Register or attempt to register any confusingly similar trademarks, domains, or business names

  4. No Implied Rights
    Except as expressly stated in these Terms, no license, right, or interest in any intellectual property is granted by implication, estoppel, or otherwise.

  5. Feedback and Suggestions
    Any feedback, ideas, improvements, or suggestions provided by customers regarding products or services shall become the property of Eagle Rock Technologies, Inc. and may be used without restriction or compensation.

  6. Enforcement and Remedies
    Eagle Rock Technologies, Inc. reserves the right to enforce its intellectual property rights to the fullest extent permitted by law, including seeking injunctive relief, damages, and recovery of legal fees.

  7. Third-Party Intellectual Property
    All third-party trademarks and intellectual property referenced remain the property of their respective owners and are used for identification purposes only.

  8. Reporting Infringement
    Suspected infringement, counterfeiting, or unauthorized use of Eagle Rock Technologies, Inc.’s intellectual property should be reported promptly to the Company.
